Terms and Conditions of Sale

These Terms and Conditions of Sale govern purchases made from Le Pot Gourmand inc., a corporation incorporated in Québec and registered under Québec enterprise number NEQ 1181018582.
Le Pot Gourmand inc. operates an online store offering shelf-stable, ready-to-eat prepared meals, packaged in glass jars and preserved through heat treatment.
By placing an order on our website, you agree to these Terms and Conditions of Sale.

2. Products
Le Pot Gourmand offers heat-treated prepared meals packaged in glass jars, which may be stored at room temperature according to the instructions shown on the product label.
Product photos, descriptions and visuals displayed on the website are provided for informational purposes only. We make every effort to present our products accurately, but slight variations may occur due to small-batch preparation, ingredient availability or recipe updates.
The information shown on the product label, including the ingredient list, allergens, lot number, best-before date and storage instructions, prevails over any information displayed online.
3. Allergens and food precautions
Our products may contain or may have come into contact with allergens, including gluten, milk, eggs, soy, mustard, tree nuts, peanuts, sesame, fish, seafood or other recognized allergens.
Customers are responsible for carefully reading the product label before consumption. In case of allergy, food intolerance, specific dietary requirement or doubt, the customer must contact us before consuming the product.
Le Pot Gourmand inc. cannot be held responsible for a reaction related to an allergy, intolerance or dietary restriction when the relevant information is provided on the product label.
4. Prices and taxes
Prices are displayed in Canadian dollars (CAD).
Applicable taxes, when required, are calculated and displayed before payment confirmation. The total amount shown at checkout is the final amount payable by the customer.
Le Pot Gourmand inc. reserves the right to change its prices at any time. Products are billed at the price displayed at the time the order is confirmed.
5. Orders
The customer is responsible for the accuracy of the information provided when placing an order, including name, email address, phone number, delivery address or any information required for order pickup.
An order is considered confirmed once payment has been accepted and an order confirmation email has been sent to the customer.
Le Pot Gourmand inc. reserves the right to refuse or cancel an order in the event of an obvious error, payment issue, product unavailability, suspected fraud or any situation preventing normal fulfillment of the order.
6. Payment
Payments are made online through secure payment providers, including Stripe, or any other payment solution made available on the website.
Payment information is processed by the secure payment provider. Le Pot Gourmand inc. does not store full credit card numbers.
The order will only be prepared or released once payment has been confirmed.
7. Delivery, pickup and collection points
Depending on the options available at the time of order, the customer may be offered delivery, pickup or collection from a partner collection point.
When a partner collection point is used, it acts solely as the location where the order is handed over. Payment remains made to Le Pot Gourmand inc., which remains the seller of the product.
The customer must present the information required to identify the order at pickup, including the receipt, order number or any other requested proof.
The customer is responsible for collecting the order within the timeframe and according to the terms indicated at the time of purchase.
8. Delivery and incorrect address
When delivery is offered, the customer is responsible for providing a complete and accurate address.
Le Pot Gourmand inc. cannot be held responsible for delays, losses or failed deliveries caused by an incomplete, incorrect or inaccessible address.
If an order is returned to Le Pot Gourmand inc. due to an address error or failure by the customer to retrieve the order, additional fees may be charged for reshipment.
9. Receipt and inspection of products
The customer must inspect the products upon receipt or pickup.
A product must not be consumed if the jar is cracked, broken, open, if the lid appears altered, if the safety seal is compromised, if the product has an abnormal smell, unusual appearance or any other sign of deterioration.
In the event of an apparent issue, the customer must contact Le Pot Gourmand inc. as soon as possible, ideally within 48 hours of receipt or pickup, with photos of the product, jar, label and packaging whenever possible.
10. Storage and use
Products must be stored according to the instructions shown on the label.
Before opening, products must be stored in a clean, dry, temperate place away from direct sunlight, unless otherwise indicated.
After opening, the product must be refrigerated and consumed according to the label instructions.
Le Pot Gourmand inc. cannot be held responsible for product deterioration caused by improper storage, improper handling or use that does not comply with the instructions.
11. Returns, exchanges and refunds
For food safety reasons, food products generally cannot be returned or exchanged once they have been delivered or handed over to the customer, except in the case of an order error, damaged product, apparent defect or issue attributable to Le Pot Gourmand inc.
Any refund or replacement request must be sent by email to contact@le-pot-gourmand.ca with the order number, a description of the issue and, whenever possible, photos of the product concerned.
Each request is reviewed on a case-by-case basis. When a request is accepted, Le Pot Gourmand inc. may offer, depending on the situation, a replacement, credit or refund.
No refund will be granted for a product that has been fully consumed, improperly stored, improperly handled or for which the issue was not reported within a reasonable timeframe.
12. Product availability
Products are offered subject to availability.
In the event of unavailability after an order has been placed, Le Pot Gourmand inc. will contact the customer to offer an appropriate solution, which may include a replacement, credit or refund.
13. Liability
Le Pot Gourmand inc. undertakes to prepare, package and distribute its products in accordance with applicable Québec standards and rigorous food safety practices.
Le Pot Gourmand inc. cannot be held liable for improper storage, improper handling, non-compliant use, consumption after opening beyond the recommended period, or failure to follow the instructions shown on the label.
To the extent permitted by law, the liability of Le Pot Gourmand inc. is limited to the amount paid by the customer for the product concerned.
14. Personal information
Personal information provided when placing an order is used only to process the order, provide customer service, manage delivery or pickup, comply with our legal obligations and improve our services.
Le Pot Gourmand inc. takes reasonable measures to protect its customers’ personal information.

15. Intellectual property
The website content, including texts, images, photographs, logos, recipes, visuals, trademarks, graphic elements and promotional content, belongs to Le Pot Gourmand inc. or its authorized partners.
Any reproduction, use, modification or distribution without prior written authorization is prohibited.
16. Changes to these terms
Le Pot Gourmand inc. may modify these Terms and Conditions of Sale at any time.
The terms applicable to an order are those in effect at the time the order is confirmed.
17. Governing law
These terms are governed by the applicable laws of Québec and Canada.
In the event of a dispute, the parties will first attempt to resolve the matter in good faith. Failing an agreement, the dispute will be submitted to the competent courts of Québec, subject to applicable consumer rights.
